These FieldPilot Terms of Service (the “Terms”) constitute a legal agreement between PayNation, LLC, including its FieldPilot-branded services (“FieldPilot,” “we,” “our,” or “us”), and the individual or entity that creates an account or otherwise uses the FieldPilot platform (the “End User,” “you,” or “your”).
These Terms govern your access to and use of:
- the FieldPilot web application
- the FieldPilot mobile application
- software-as-a-service tools
- APIs and integrations
- related websites, technology, and services
(collectively, the “Services”).
By accessing or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must stop using the Services immediately.
- Key Definitions
Account – the unique profile created by or for you to access the Services.
Authorized Users – employees, contractors, technicians, administrators, or other personnel you authorize to access your FieldPilot account.
Content – data, files, schedules, job records, invoices, customer records, communications, documents, images, payment details, and other material you upload or store in the Services.
Customers – your end customers whose information you manage through FieldPilot.
Integrations – optional third-party platforms connected to the Services (e.g., accounting systems, payment processors, SMS services).
- Eligibility, Access, and Term
You may use the Services only if you:
- are at least 18 years old; and
- have authority to bind yourself or the business you represent.
You must comply with all applicable laws and regulations.
FieldPilot may refuse, suspend, or terminate access—at any time, with or without notice—if:
- you violate these Terms;
- your use poses risk to us, other users, or our systems; or
- required to comply with law or regulation.
These Terms remain effective while you use the Services (the “Term”).
- License Grant
Subject to these Terms, FieldPilot grants you a limited, revocable, non-exclusive, non-transferable license to access and use the Services for your internal business purposes.
You may authorize Authorized Users to access your account, and you are responsible for all actions taken by anyone using your credentials or account.
You acquire no ownership rights in the Services. All software, code, features, designs, trademarks, documentation, and technology remain the exclusive property of FieldPilot and its licensors.
- Acceptable Use
You agree not to:
- resell, sublicense, or redistribute the Services;
- operate a competing platform using or derived from the Services;
- copy, modify, or create derivative works;
- reverse engineer or access source code;
- upload viruses, malicious code, or disrupt performance;
- store or transmit unlawful, harmful, defamatory, or infringing material;
- use the Services to violate privacy, consumer protection, or marketing laws;
- impersonate any person or misrepresent affiliation.
We may suspend access for suspected abuse or unlawful activity.
- Account Security & Confidentiality
You are responsible for:
- safeguarding logins and passwords;
- limiting access to Authorized Users only;
- notifying us promptly of any unauthorized access or breach.
We may suspend access where unauthorized activity is suspected.
- Your Content & Data Responsibility
You retain ownership of Your Content.
You grant FieldPilot a limited license to host, store, process, transmit, back up, and display Your Content solely to operate and support the Services.
You are responsible for:
- ensuring you have the legal right to collect and store Customer data;
- providing required notices and obtaining consents when required by law;
- accuracy and legality of Your Content.
Where applicable, you are the “data controller,” and FieldPilot acts as a “service provider” / “processor.”
- Third-Party Integrations & Payments
FieldPilot may integrate with optional third-party services, including accounting systems, messaging tools, analytics, or payment processors.
Use of integrations may require acceptance of third-party terms. FieldPilot is not responsible for third-party systems, availability, or data handling.
Payments Through Integrations
If you accept payments through connected providers:
- FieldPilot does not process or hold funds;
- FieldPilot is not a bank, money transmitter, or payment processor;
- settlement, chargebacks, and disputes are managed by the payment provider.
Any disputes between you and your Customers regarding charges are solely your responsibility.
7B. SMS & TEXT MESSAGING
FieldPilot may allow you to send text messages to Customers (e.g., reminders, updates, links, notifications).
Consent & Compliance
You are responsible for:
- obtaining legally required consent before sending messages;
- honoring opt-out requests (e.g., “STOP”);
- complying with applicable laws, including the Telephone Consumer Protection Act (TCPA), CAN-SPAM where applicable, and carrier rules.
FieldPilot may provide tools to assist with compliance, but you remain solely responsible for your messaging practices.
Carrier Charges
Standard text and data rates may apply based on the recipient’s mobile carrier plan. FieldPilot does not control or reimburse carrier fees.
Delivery Disclaimer
Message delivery is not guaranteed. We may suspend messaging if spam, abuse, or compliance risks are detected.
- Fees, Billing, Cancellations & Refunds
Subscription Fees
Pricing and billing terms are described in your order form, subscription page, or separate services agreement. You agree to pay all applicable:
- subscription fees;
- usage charges;
- taxes and assessments.
Failure to pay may result in suspension or termination.
Billing Cycle
Subscriptions are billed in advance and renew automatically (monthly or annually, as applicable).
Cancellation Policy — 30-Day Notice
You may cancel by submitting written notice via email to:

Cancellation requires thirty (30) days’ advance written notice.
Effect of Cancellation
If you cancel during a billing period:
- service remains active through the end of the current paid billing cycle;
- automatic renewal stops after the notice period;
- access ends after the final paid term.
No Refund Policy
Except where prohibited by law:
All fees are non-refundable.
No refunds or credits are issued for:
- partial billing periods;
- unused features or inactivity;
- mid-cycle cancellation;
- termination resulting from violation of these Terms.
Please export any necessary data before cancellation becomes effective.
- Modifications to Services
We may modify, improve, or discontinue features at any time. Continued use after changes constitutes acceptance. We are not liable for any resulting impact or loss of functionality.
- Termination & Data Handling
We may suspend or terminate your account for:
- breach of these Terms;
- legal, compliance, or security concerns;
- nonpayment.
You may stop using the Services at any time, but cancellation is effective only after your 30-day written notice period.
Upon termination:
- your license ends;
- access will be disabled;
- we may delete or anonymize Your Content after a reasonable retention period, unless prohibited by law.
You are solely responsible for exporting Your Content prior to termination. FieldPilot has no obligation to retain data post-termination.
- Disclaimers
The Services are provided “AS IS” and “AS AVAILABLE.”
We do not warrant that:
- the Services will be uninterrupted or error-free;
- data will always be secure or available;
- integrations will function without issue;
- calculations, insights, or outputs will be accurate for every purpose.
Internet-based systems inherently involve risk. Use is at your sole risk.
- Limitation of Liability
To the fullest extent permitted by law, FieldPilot shall not be liable for:
- lost profits or revenue;
- loss of data or business interruption;
- indirect, incidental, punitive, or consequential damages.
Our total aggregate liability for any claim arising from or related to the Services shall not exceed:
the total fees paid by you to FieldPilot during the two (2) months preceding the event giving rise to the claim.
- Indemnification
You agree to indemnify, defend, and hold harmless FieldPilot, its affiliates, officers, directors, employees, and partners from any claims, damages, losses, costs, and expenses (including attorneys’ fees) arising out of:
- your use of the Services;
- your violation of these Terms;
- your violation of law;
- disputes involving your Customers;
- Your Content or messaging practices.
This obligation survives termination.
- Mobile App & App Store Terms
If you download the Mobile App from Apple or Google:
- you must comply with applicable store terms;
- app stores are not responsible for support, warranty, or claims related to the App.
- Governing Law & Venue
These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Any dispute must be brought exclusively in the state or federal courts located in Orange County, California.
- Assignment
You may not assign these Terms without our prior written consent. We may assign in connection with merger, sale, restructuring, or transfer of assets.
- Severability & Waiver
If any provision is deemed invalid, the remaining provisions continue in effect. Failure to enforce any provision is not a waiver of rights.
- Entire Agreement
These Terms constitute the entire agreement regarding your use of the Services and supersede prior agreements relating to FieldPilot.
